Welcome to Luxx Boutique! Thanks for shopping with us—we’re excited you’re here. These Terms of Service (“Terms”) explain how our website, services, and store work. By visiting or purchasing from our site or in-store, you agree to these Terms.

1) Who We Are

Luxx Boutique (“Luxx,” “we,” “us,” “our”) sells apparel, accessories, and related products online and in-store. These Terms apply to all site visitors, customers, and others who access our services.

2) Using Our Site

You agree to use the site only for lawful purposes and in a way that doesn’t harm Luxx or other users. You must be the age of majority in your state (or have a parent/guardian’s permission) to make purchases.

3) Accounts

If you create an account, you’re responsible for keeping your login safe and for all activity under your account. Please let us know right away if you suspect unauthorized use.

4) Orders, Pricing & Availability

  • Order acceptance. We may accept or cancel orders at our discretion (e.g., suspected fraud, inventory errors). If we cancel, we’ll refund your original payment method.

  • Pricing. Prices are shown in USD and may change without notice. Sale pricing and promotions may be time-limited and are subject to terms listed in the promotion.

  • Taxes & shipping. You’re responsible for applicable taxes, duties, and shipping charges shown at checkout.

  • Inventory. We do our best to reflect current availability, but items may sell out.

5) Payments

We use third-party processors (e.g., Shopify Payments, Apple Pay, Google Pay, PayPal) to securely process payments. By purchasing, you agree to their terms and policies. We don’t store full credit card numbers.

6) Shipping & Delivery

We ship to the address you provide. Delivery times are estimates and may vary due to carrier delays or factors outside our control. Risk of loss passes to you when the carrier takes possession.

7) Returns & Exchanges

We want you to love your purchase! Please see our Return/Exchange Policy (posted on our site or available in-store) for eligible items, timelines, and instructions. Items must be unworn, unwashed, with tags attached (unless the policy says otherwise). Final sale items are not returnable.

8) Product Colors & Sizing

We work hard to display colors and details accurately. Different screens and lighting can affect how items appear. Sizing can vary by brand and style; reach out if you need help before ordering.

9) Promotions, Gift Cards & Store Credit

  • Promos. Discounts cannot be combined unless explicitly stated. Some exclusions may apply.

  • Gift cards. Treat gift cards like cash; lost or stolen cards may not be replaced. Gift cards and store credits are not redeemable for cash unless required by law.

  • Expiration. We follow applicable law regarding expiration and fees.

10) Reviews & User Content

If you post reviews, photos, or other content, you grant Luxx a non-exclusive, royalty-free license to use, reproduce, and share that content for marketing or operational purposes. Please share only content you own and keep it respectful—no illegal, offensive, or infringing material.

11) Acceptable Use (What’s Not Allowed)

No scraping, hacking, interfering with site security, spamming, or using our site for unlawful or harmful purposes. Don’t misrepresent your identity or attempt to resell products in a way that violates our policies.

12) Intellectual Property

Our site, logos, product photography, and other content are owned by Luxx or our licensors and protected by IP laws. You may not use our trademarks or content without written permission.

13) Third-Party Services & Links

We rely on third-party tools (e.g., payment processors, analytics, shipping partners). We’re not responsible for third-party websites or their practices. Check their terms and privacy policies.

14) SMS & Email Communications

If you opt in, we may send texts or emails about orders and promos. SMS: Reply STOP to opt out. Email: Use the unsubscribe link. Message/data rates may apply.

15) Disclaimer of Warranties

Our products and services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t guarantee uninterrupted or error-free site operation.

16) Limitation of Liability

To the fullest extent permitted by law, Luxx and its owners, employees, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits/revenue/data, arising from your use of the site or products. Our total liability for any claim will not exceed the amount you paid for the product(s) at issue.

17) Indemnification

You agree to indemnify and hold Luxx harmless from any claims, damages, liabilities, and expenses (including attorneys’ fees) arising out of your misuse of the site, violation of these Terms, or infringement of others’ rights.

18) Governing Law; Disputes

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law rules. You agree that disputes will be handled in state or federal courts located in LaSalle County, Illinois, unless small-claims rules or applicable law require otherwise.

Optionally, if we mutually agree in writing, we can use mediation or arbitration to resolve a dispute more quickly and privately.

19) Changes to the Site or Terms

We may update products, features, and these Terms from time to time. When we do, we’ll update the “Last updated” date above. Continued use of our site after changes means you accept the updated Terms.

20) Severability & Entire Agreement

If any part of these Terms is found invalid, the rest remains in effect. These Terms (plus any posted policies like the Return/Exchange Policy and Privacy Policy) are the entire agreement between you and Luxx regarding your use of our site and services.
